1. Acceptance of Terms
By accessing or using
www.finduslocally.com (“Site”) and its services (“Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please refrain from using the Site.
2. Modifications
We may update these Terms at any time. Changes become effective immediately upon posting on the Site. Your continued use constitutes acceptance of the revised Terms.
3. Our Role
Find Us Locally is an online platform designed to connect customers (“Customers”) with independent tradespeople (“Tradespeople”). We do not employ, endorse or act as an agent for any Tradesperson. The contract for any services is strictly between the Client and the Tradesperson. We are not a party to that contract and are not liable for the performance, quality or outcome of any services provided.
4. Eligibility
You must be at least 18 years old and located in Ireland to use the Site. If you use the Site on behalf of an organisation, you confirm you have authority to bind it to these Terms.
5. Intellectual Property
All content on the Site (including text, graphics, logos and design) is owned by or licensed to Find Us Locally. You may not copy, reproduce, distribute or reverse-engineer any part of the Site without our written permission.
You retain ownership of the content you upload but grant Find Us Locally a non-exclusive, royalty-free licence to use, display and distribute it as necessary to operate and promote the Site.
6. User Content
You are responsible for any content you post or submit to the Site. By submitting content, you grant Find Us Locally a non-exclusive, royalty-free licence to use, display, distribute and modify it as necessary to operate the Site.
7. Responsibilities of Customers
Customers are solely responsible for:
- Conducting their own due diligence before engaging a Tradesperson.
- Contracting directly with the Tradesperson for the required services.
- Negotiating price, scope and timing of any work.
- Complying with applicable consumer protection laws when entering into contracts with Tradespeople.
Find Us Locally does not guarantee or verify the qualifications, licences, insurance or suitability of any Tradesperson.
8. Responsibilities of Tradespeople
Tradespeople using the Site agree to:
- Hold and maintain all required licences, permits, insurance policies and certifications necessary to lawfully provide their services in Ireland.
- Ensure that the information and descriptions posted on their profiles are accurate, up to date and not misleading.
- Deliver services in accordance with Irish law and relevant industry standards.
- Contract directly with Customers for the services offered, including negotiating price, scope and timing.
- Comply with applicable data protection and privacy laws when handling Customers’ personal data.
Tradespeople acknowledge that Find Us Locally is not responsible for verifying or maintaining their licences, permits or insurance, nor for the quality or outcome of any services they provide. Any legal or regulatory non-compliance is solely the responsibility of the Tradesperson.
Free Trial and Membership
We may offer a time-limited free trial during which Tradespeople can list their services at no charge.
Once the free trial ends, continued listing or access to enhanced features may require payment of a membership fee.
Membership options, pricing and benefits will be displayed on the Site before any payment is taken.
9. Privacy and Cookies
Our [Privacy Statement] explains how we collect, use and protect personal data, and our [Cookie Policy] explains how we use cookies. By using the Site, you consent to our handling of your data in accordance with those policies.
Tradespeople confirm that they have read our Privacy Statement and consent to the publication of their listings and contact details on the Site.
10. Disclaimers & Limitation of Liability
The Site and Services are provided “as is” and “as available”. We do not guarantee that the Site will be uninterrupted or error-free, or that listings will result in enquiries or contracts.
To the fullest extent permitted by Irish law, Find Us Locally is not liable for any indirect, incidental, special or consequential damages, or loss of profits, arising from your use of the Site.
We do not vet or endorse Tradespeople. Customers contract with Tradespeople at their own risk.
11. Indemnification
You agree to indemnify and hold harmless Find Us Locally from any claims, damages, liabilities, costs (including legal fees) arising from your use of the Site, your interactions with other users, or your breach of these Terms.
12. Mediation and Dispute Resolution
Before commencing court proceedings, you agree to attempt to resolve any dispute with Find Us Locally through good-faith negotiation and, if necessary, mediation with an independent mediator based in Ireland. Only if mediation fails may either party commence legal action in court.
13. Termination
We may suspend or terminate your access at our discretion for violations of these Terms or disruptive behaviour, with or without notice.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland. Subject to the Mediation clause above, disputes will be resolved exclusively in the Irish courts.
